Formation Of Co-operative Housing Society.

1) Rules:-
1)     As per section (10) MCS act Builder have to form register body
     after sale of 60% flats on or before 6 months But occupation 
     certificate is must.
2)      If Builder does not co-operate for registration, flat 
     purchaser can form non-cooperation society.
3)      Legal notice to be send to builder before the registration 
     process.
4)      First Membership Cannot is give to minor or unsound person.
5)      When builder have unsold flats make builder a member, if not 
     after sale of said flat make purchaser member with premium 
     charges
6)      If there is less than 10 members but more than 5 society can 
     form but FSI of that plot must be use totally and carpet area        of the said flats not to be more than 750 sq.ft and members 
     must be not own more than one flat.

2) Process:-
1) Informal General Meeting:-
        A) Issue notice to all flat purchasers.
        B) Finalise society Name at least 3 and maximum 5 names.
        C) Appoint Chief Promoter /President.
        D) Agenda & Minutes Should be Maintain.

2) Name Reservation:-
        A) Send latter to registrar for name reservation within a
           month after Informal General Meeting.
        B) Registrar will send return latter of reserved name & 
           permission for opening of bank a/c.

3) Open a bank a/c:-
        A) Bank a/c must be opened in state or district co-op bank
           only.
        B) Deposit share money & entrance fee received from 
           promoters.
        C) Collect certificate from bank.

4) Registration fees:-
       A) Processing fees in form of court fee stamp on application 
          form.
       B) Registration fees in form of challan at state bank of 
          India.

5) Registration Process:-
       A) Proposal must be submitted within 3 months from receipt of
          name reservation latter if failed Application must be send
          to registrar will get 3 month extension this can repeat on
          more time Total 9 months.
       B) Registering authority will issue certificate of
          registration under section 9 (1) and copy of By-laws & 
          memorandum.
       C) Certificate must be issued within 2 Months from submission
          of application.
       D) If no decision is taken then proposal must send to higher
          authority within 15 days.
       E) Higher authority must take decision in 2 months.
       F) If no decision take in 4.5 months society has been 
          registered as deemed under section 9(2)

3) Documents Required:-

  1) Form A under rule 4 of the MCS Rules 1961 which is application
     form for registration of Society (4 copies) must be signed at 
     least 90% promoters. Should be attested by chief Promoters.
  2) Statement A which is particulars of promoter’s members and
     tenements allotted to Those such as name, age, occupation,
     current residential address, cost of share amount Etc.
  3) Statement B the prescribed statement in form B required 
     particulars of proposed Society.
  4) Statement C prescribed statement in form C required further 
     information regarding each of the promoters.
  5) Four copies of by-laws (ready-made) duly signed by all the 
     promoters.
  6) Statement of accounts containing the preliminary income and
     expenditure of the Proposed society duly signed by chief 
     promoter.
   7)Bank balance certificate.
   8)Certificate of the title of the land by advocate of good 
     standing.
   9) Specimen of Agreement for sale of tenements.
   10)Scheme showing viability of the society signed by the chief
      promoter supported by an Architect Certificate.
 11) Declaration by at least 10 promoter members including the            chief promoter stating that There residence is within the area
     of operation of the society.
12) Undertaking of the chief promoter in form x/y/z as applicable.
13) Challan showing the deposit of the registration fees with bank.
14) Copy of the approved plan.
15) Occupation Certificates.
16) If builder is not supporting affidavit to be submitted with the
    sign of chief promoter.
